This DigiShop App and DigiShop Partner App (the "App") is owned and operated by INFINITYPOINTER INDIA PRIVATE LIMITED (hereinafter referred to as "we," "us," or "our"). By accessing or using the App, you (the "User") agree to be bound by the terms and conditions set forth in this agreement (the "Terms of Use"). If you do not agree to these terms, please do not use the App.

Eligibility:

Use of the App is void where prohibited by law. By using the App, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions set forth in these Terms of Use.

App Services:

The App provides a platform for Users to interact with businesses and purchase products or services. We do not endorse any business or products listed on the App and are not responsible for any transactions or interactions between Users and businesses.

User Conduct:

Users are prohibited from using the App for any illegal or unauthorized purpose. Users must also not, in the use of the App, violate any laws in their jurisdiction (including but not limited to copyright laws).

Intellectual Property:

The App and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection, and arrangement thereof), are owned by us, our licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Third-Party Links:

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Disclaimer of Warranties:

The App is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App.

Limitation of Liability:

In no event shall we, our directors, officers, employees, agents, partners, or suppliers be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, good-will, or other intangible losses, resulting from

(ii) any conduct or content of any third party on the App;
(iii) any content obtained from the App; and
(iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

User Generated Content:

The App may allow users to post, upload, or submit content such as reviews, comments, and images. By submitting any User Generated Content (UGC) to the App, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable license to use, reproduce, modify, publish, distribute, and display such UGC in any form or medium. You represent and warrant that you have the right to grant us this license for any UGC you submit, and that such UGC does not infringe on any third party's intellectual property rights.

You also consent to us using your data to personalize your experience and improve the App, as well as for marketing, research and analytics purposes.

Security:

We take reasonable steps to protect your information and data from loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, no security measure can be 100% secure, and we cannot guarantee the security of your information and data. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from us at all times.

No Resale or Unauthorized Commercial Use:

You agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes any portion of the App, use of the App, or access to the App.

Force Majeure:

We will not be liable for any delay or failure to perform any of our obligations under these Terms of Use if such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, war, civil unrest, natural disasters, strikes, or interruptions to public or private telecommunications networks.
